Default New Law discussed in Italy. AND ITS INTERESTING!!

Italian Senate plans a law against "mental manipulation"

    http://www.senato.it/japp/bgt/showdo...rt_a1&parse=no

    google-translate:

Article 613-bis. - (Mental manipulation). - Unless the act constitutes a more serious offense, whoever, by conditioning techniques of personality or suggestion charged with material resources, or psychological, puts someone into a state of awe that continued to exclude or limit the freedom of self-determination is largely punished imprisonment from two to six years.

If the act is committed as part of a group that promotes or practical activities aimed at creating or exploiting psychological or physical dependence of people who participate, or if the offender acted to commit an offense, the penalties referred to first paragraph are increased by one third to half.
If the acts provided for in paragraphs 1 and 2 are committed against a person less than eighteen years of age, the penalty can not be less than six years in prison

I am working on a decent translation atm, but basically its 2 to 6 years in prison if you fuck somebody's mind up. 2.5 to 9 years if you do it in a group.

Awaiting translation, this could be intererstin'
'Live a good life. If there are gods and they are just, then they will not care how devout you have been, but will welcome you based on the virtues you have lived by. If there are gods, but unjust, then you should not want to worship them. If there are no gods, then you will be gone, but will have lived a noble life that will live on in the memories of your loved ones. I am not afraid.'

    Default Well

OK, I get the well-meaningness of this - but how can something like that be proved? I know Italy has a different legal system than (say) USA (where something like this would be almost impossible to prove, in a criminal court).

sea of $hit is very good at manipulating and using laws for its own benefit -everywhere on the planet. I imagine they'd find a way to 'do' ( ) this one too.

Italian law, as most European laws, comes methodically from corpus iuris civilis (about 550 ad)

Usually you would take the literal word from the law and then apply it to the deed to see if the condition is met.

To do that, you define the words:

    For that particular law:

Someone needs to have been put in a state of soggezione/dependancy (define) by either physical or psychological means (define) which hamper (define) heavily (define) with his selfdetermination (define) by the defendant.

Once you have your definitions you have to show causality of the actions of the defendant to the effect on the victim. To do that you ask if the actions of the defendant are the condito sine qua non, i.e. if the defendant(s) hadn't repeatedly done the TRs with the defendant, would the defendant have been in the state of dependancy? If causality is shown, then the accusation is proven.

Trouble here is ofc the definition of the means, i.e. are the TRs and the tech a psychologial means to put you in a dependant state. Lots of expert testimony needed for that.

The interesting thing is tho, if after all foreseeable appeals the High Court decides that the tech is a means to put someone else in a dependant state, applying the tech to anyone would be illegal -> scientology outlawed.

See, you better don't mess with nuns in Italy :D

An interesting law..........would be even more so if they made it retroactive applying to past offenses. :D

That would make illegal: religion, politics, media, & interpersonal relationships. I'll believe it when they close ALL the churches & religious schools in italy.

I am really having trouble doing a decent translation, some things just dont work in English due to other law system. The google translation wasnt all bad, from what I see now.
